France Delays Passing 3-Strike Copyright Penalty Scheme

The French National Assembly faces yet another delay in its attempt to implement its 3 strikes and your off the Internet approach to copyright enforcement.

The legislation initially intended to allow a central body to issue 'warnings' to French online copyright infringers and then ban them from the Internet after their third warning. France's Constitutional Court ended that plan, finding that only a Court has the power to ban someone from the Internet. Now the Assembly must wait for a new session before passing its new enforcement regime. The new regime allows courts to ban infringing users through a 'penal order', meaning a judge would issue the order without giving the accused a chance to appear before the court.
